Design Timeline


- Fill out Armillary’s simple Design Patent Application Form.

- The Design Patent Application Form allows you to pay the application and government filing fees by credit card or PayPal. If you prefer to pay by check or cash, just give us a call after you've completed the Application Form.

- Within one business day, an Armillary patent attorney will call you to discuss your design in depth. Any sketches, photos, or additional data that you have can be sent to Armillary via email or U.S. Mail.

- An Armillary patent attorney will conduct a thorough patent search. This search is performed to uncover existing designs (prior art) that may be similar to your design. The search covers U.S. patents and patent applications, European patents, WIPO (World Intellectual Property Organization) documents, Japanese patent abstracts, and limited non-patent literature. A search report with attorney analysis will be forwarded to you, and an Armillary patent attorney will be available to discuss the results with you. - Once we have the data needed to describe your design in the application, your design patent application and patent drawings will be completed within 10 days.

- Your application will be filed with the USPTO and you will receive a USPTO receipt with your “Patent Pending” application number.

- Twelve months is the average time required for the USPTO will examine your design patent application and make a decision granting your patent. You pay a government patent issuance fee and receive your design patent registration number.

Armillary offers the design patent application, written by an experienced patent attorney, at the competitive rate of $1200, plus government filing fee. For most applicants the government fee is $190, giving a total out of pocket cost of $1390.
